MB’S PRIVACY POLICY.

The Privacy Act 2020 helps protect the confidentiality and security of personal information. MB Insurance Group Pty Limited (MBIG) (NZBN 9429053784308) is committed to protecting the personal information we collect about you when arranging and managing your insurance policy and claims. We follow the Information Privacy Principles (IPPs), which set out how we collect, use, share and protect your information. 

Collection and storage of your personal information 

We only collect personal information that is relevant to the service or product we provide to you. This may include your name, address, contact details and date of birth. It may also include information such as traffic offences, criminal convictions or health-related information. We use this information to assess insurance risks and properly manage your claims, or claims made against you. 

 We store personal information electronically and in physical records using reasonable security safeguards designed to protect it from loss, misuse, interference, unauthorised access, modification or disclosure. 

As part of our business, we may use third-party suppliers, including technology providers, web hosting providers, secure document destruction services and storage management facilities. We may also provide your personal information to the insurer named on your policy document. That insurer has its own privacy policy, which is available on its website. 

MBIG will only use your personal information for the main purpose it was collected, or to market related MBIG products or offers that may interest you. We will not distribute or sell your personal or sensitive information to another company for marketing purposes. There may be occasions where we collect personal information about you from a third party rather than directly from you. We do this where permitted by the Privacy Act 2020, including where you have authorised the collection, where the information is required to assess, arrange or administer your insurance policy or a claim, or where it is impracticable to collect the information directly from you. We may also collect information where another lawful basis under the Privacy Act 2020 applies.  

Third parties from whom we may collect personal information include: 

  • the policyholder where they are responsible for arranging insurance cover for you; 
  • other insured persons covered by the policy; 
  • insurance brokers, agents and other intermediaries associated with your policy; 
  • insurers, insurance industry databases, claims registers and fraud prevention services for underwriting, claims assessment, verification and fraud prevention purposes; 
  • assessors, investigators, repairers and service providers involved in administering your policy or claim; 
  • law enforcement agencies, government agencies and public registers where authorised by law; 
  • telecommunications, digital and social media service providers where relevant to investigating or managing a claim; and 
  • any other person or organisation authorised by you. 

Where required by law, we will take reasonable steps to notify you that we have collected your personal information indirectly, including the purpose of collection, the source of the information and your rights to access and correct that information.

If you do not provide requested information 

If you do not provide the personal information we request, we may be unable to consider your application for insurance, arrange or renew insurance cover, administer your policy, assess or process claims, investigate claims, recover costs, comply with legal or regulatory obligations, or otherwise provide you with our products and services. 

Disclosure of your personal information to third parties 

We may disclose your personal information to third parties who assist us in providing our services including: 

  • You, any person you authorise, or your insurance broker; 
  • Another person named as a co-insured on your policy, to confirm whether full disclosure has been made to us; 
  • The insurer of the insurance product you have applied for or purchased;  
  • A financier or interested party named on your policy schedule, but only to provide a certificate of currency or confirm their financial interest in a claim; 
  • Another insurer, to confirm your no claim bonus, assess insurance risks or help with an investigation; 
  • An organisation that provides banking services to you, to arrange direct debits or other payment transactions, or to confirm payments you have made to us; 
  • An approved external dispute resolution scheme, including the Insurance & Financial Services Ombudsman Scheme, for dispute resolution purposes; 
  • A motor vehicle dealership, corporate authorised representative or insurance agent who has referred this business to MBIG; 
  • The Insurance Council of New Zealand’s Insurance Claims Register to help detect and prevent insurance fraud; 
  • A repairer or other supplier of goods or services, to repair, replace, recover, relocate or dispose of your insured property; 
  • An assessor or investigator appointed to carry out specialised services;  
  • A legal service provider or recovery agent, to defend a claim made against you, recover our costs including your excess, or seek legal advice about accepting a claim; 
  • To a witness to a claim (for the purpose of obtaining a witness statement);  
  • Another party to a claim, to obtain a statement, seek recovery from them, or defend a claim made by a third party. 

 

Disclosure of personal information outside New Zealand 

We may disclose, process and store personal information outside New Zealand, including in Australia and the United Kingdom.  

Before disclosing personal information overseas, we will take reasonable steps to ensure that the recipient is subject to privacy obligations that provide comparable safeguards to those contained in the Privacy Act 2020, or that another lawful basis for the disclosure applies under that Act. 

Retention of personal information 

We will retain your personal information only for as long as it is required for the purposes for which it was collected, including administering insurance policies and claims, complying with legal, regulatory and contractual obligations, resolving disputes, and conducting legitimate business activities. 

When personal information is no longer required, we will take reasonable steps to securely delete, destroy or de-identify the information in accordance with our record retention and information security practices. 

Accuracy, access and correction of personal information 

We will take reasonable steps to ensure that the personal information we collect, use and disclose is accurate, complete, relevant, up to date and not misleading. 

You may request access to the personal information we hold about you and request correction of any information that you believe is inaccurate, incomplete, out of date or misleading. If we decline to make a requested correction, you may request that a statement of correction be attached to your personal information. 

New Zealand Motor Vehicle Register 

New Zealand Transport Agency Waka Kotahi (“NZTA”) operates the Motor Vehicle Register (“MVR”). The MVR records and stores information about vehicles registered in New Zealand and the people those vehicles are registered to (“MVR Information”). 

Under section 241 of the Land Transport Act 1998 (“LTA”) and the New Zealand Gazette Notice 2022-au4072 dated 28 September 2022, MB Insurance is authorised to access MVR Information to assess or process vehicle insurance policies or claims. 

You can opt out of having your name and address made available through the MVR under section 241 of the LTA. However, MB Insurance may still access opted-out information under section 237 of the LTA for the purposes stated above. This is because MB Insurance has been granted additional access rights under the Official Information Act 1982. Privacy breaches 

If a privacy breach occurs, we will take reasonable steps to contain and investigate it, assess the risk of harm, and reduce any resulting harm. Where a privacy breach has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as soon as practicably possible, unless an exception under the Privacy Act 2020 applies. 

Privacy Complaints 

If you believe we have not protected your personal information in line with current New Zealand privacy law and want to make a formal complaint, please contact us using the details below. Our Compliance Manager will manage your complaint. If you are not satisfied after speaking with us, you may lodge a complaint with the Office of the Privacy Commissioner.
